Visa Refusal Appeals in Australia: AAT Guide for Nigerians and Africans

A visa refusal or cancellation can feel devastating, but in many cases, you have the right to appeal. In Australia, this process is handled by the Administrative Appeals Tribunal (AAT), which can review the Department of Home Affairs’ decision.

At Afrovo, we’ve helped Nigerians and Africans turn refusals into approvals by preparing strong, well-supported appeals. This guide explains who can appeal, how it works, and how to increase your chances of success.

What is the AAT?

The Administrative Appeals Tribunal is an independent body that reviews Australian Government decisions, including visa refusals and cancellations.
If they find the original decision was wrong, they can overturn it; meaning your visa could still be granted.

Who Can Appeal?

You may be able to appeal if:

  • Your visa application was refused inside Australia

  • Your visa was cancelled while in Australia

  • You are an eligible sponsor/nominee for a refused or cancelled visa

You cannot appeal if:

  • You applied offshore and were refused

  • Your refusal involves a “no further stay” condition (unless waived)

  • Your appeal deadline has passed

Time Limits to Apply

Deadlines are strict; miss them and you lose your right to appeal.

  • Student & Temporary Visas: Usually 7–21 days from notification

  • Skilled & Partner Visas: Varies; often 21 days

The Visa Appeal Process

  • Receive Refusal or Cancellation Notice
    Review the reason(s) given.

  • Check Your Eligibility & Timeframe
Afrovo can confirm if an appeal is possible.

  • Lodge the Appeal Online with the AAT
Pay the application fee (currently AUD $3,374 for migration cases; partial refund if successful).

  • Prepare Your Evidence & Written Submissions
This is the most critical stage—you must address the refusal reasons directly.

  • Attend Your AAT Hearing
You’ll present your case in person, via phone, or by video.

  • Receive AAT Decision
Possible outcomes: Decision affirmed (refusal stands), remitted (sent back for grant), or substituted (AAT grants visa).

Common Mistakes in Visa Appeals

❌ Submitting generic arguments instead of addressing refusal points

“My student visa was refused for weak financial proof. Afrovo helped me gather new evidence and argue my case. The AAT overturned the refusal, and I’m now studying in Sydney.”
